The cancellation action against “Buon Ma Thuot Coffee” was successful in China
Pham & Associates on behalf of Dak Lak Provincial People's Committee and the Buon Me Thuot Coffee Association (Vietnam) conducted cancellation actions against trademark registrations using geographical indications "Buon Ma Thuot" in China.
Recently, the Trademark Review and Adjudication Board under the Ministry of Industry and Trade of People's Republic of China has made Decision nos. SPZ[2013]110675 & SPZ[2013] 110669 which in favor of Buon Ma Thuot Coffee Association and cancelled two trademark registrations number 7611987 & 7970830 in class 30 under the name of Guangzhou Buon Ma Thuot Coffee Co. Ltd (China).
According to Chinese Trademark Law, If the interested party is dissatisfied with the above decisions, it may, within thirty days from receipt of the decision, institute legal proceedings to the People's Court of First Instance in Beijing - if not, the decisions will be published and effective.
