Applied-for mark  “EPIZODE”  is being opposed

Obshchestvo s ogranichennoy otvetstvennostyu "EHPIZOD" (Russia), the owner of Intl’ Application No.1549529 “EPIZOD3, figure” - (“cited mark”) - for the services of Class 39, 41 has petitioned with the IP Vietnam to oppose the national appile-for mark application No. 4-2020-23142 "EPIZODE' for the services of "reserving seats for trips..., organizing tours..." in Class 39 and the services “...reservations for performances, discotheque services, night clubs…” in Class 41 on the grounds that the contested applied-for mark is confusingly similar to the cited mark which has been widely used and recognized before, namely (i) the applied-for word mark EPIZODE and the word element of the cited mark are almost identical, and (ii) the services indicated by the applied-for mark are similar to those of the cited mark.

It’s noteworthy that in connection to this case the search conducted on the WIPO-IP Portal Madrid Monitor showed  that the Intl’ Application No.1549529 "EPIZOD3, figure" designating a number of countries, including Vietnam, has been given a Notification of provisional refusal of protection by the IP Vietnam on the grounds of likelihood of confusion with National Trademark Application No. 4-2020-23142 “EPIZODE” filed on June 19, 2020. The Notification was sent to the applicant on August 20, 2021 and set a response time limit of 3 months, but the applicant did not respond.

The case is being handled by the IP Vietnam./.
