Applied-for mark “FIZER” is opposed as filed in bad faith
Pfizer Products Inc.,the owner of National Registration (VN) no. 5398 “Pfizer, figure”; no. 162523 “Pfizer, figure“ and no.284908 “PFIZER” (the “cited marks”) for protection of products/services in Class 05 and 44 has petitioned with the IP Vietnam to oppose the applied-for mark application no. 4-2021-36849 “FIZER” (“the objected mark”) for plant protection products, namely substances that kill harmful animals, pesticides, insecticides, fungicides, herbicides... in Class 05 on the grounds that the applied-for mark is confusingly similar to the cited marks which are well-known and already registered in Vietnam; the objected trademark application is made in bad faith, misleading consumers as to the origin of products, and damaging the reputation and distinctiveness of the well-known mark Pfizer.
The case is being handled by the IP Vietnam./.
