Applied-for mark  “Gu Fashion” is opposed

Fast Retailing Co., Ltd., headquartered at 717-1, Sayama, Yamaguchi-city, Yamaguchi 754-0894, Japan, owner of National (VN) Trademark Registration no.236830 “GU, figure”, currently in effect  in Vietnam, for “clothes…; footwear, ... shoes, ...” in Class 25 (the cited trademark) has petitioned with the IP Vietnam to oppose national applied-for mark application no.4-2020-24604 “Gu Fashion” for products “Clothes; shoes; sandals; dress; sweat-wicking socks; headgear”  in Class 25 on the grounds that the applied-for mark is confusingly similar to the cited mark already registered, in particular (i) the applied-for mark "Gu Fashion" consists two components, namely "Gu" and "Fashion", among them  the dominant and distinctive element “Gu” is identical to the cited mark "GU, figure”; the component "Fashion" as it describes the products is considered non-distinctive and will not be taken into account, and (ii) the goods bearing these marks are similar or related to each other.

The case is being handled by the IP Vietnam./.
