Applied-for mark “zenith, YOGA PILATES WELLNESS” is being opposed

Publicis Media Limited, addressed at Pembroke Building, Kensington Village, Avonmore Road, London, W14 8DG, United Kingdom  (UK), owner of VN Registration of Mark No. 31057 “ZENITH MEDIA” issued on 20/5/1999 (the cited mark) for protection of services “advertising planning and placement including selection of appropriate media (radio, television, books) and placement of advertisements; advertising services; new product development, sales promotion, marketing, direct marketing...” in Class 35 has petitioned with the IP Vietnam to oppose national (VN) applied-for mark application No. 4-2022-22078 “zenith, YOGA PILATES WELLNESS”  for protection of services “...advertising, online advertising...” in Class 35 the grounds of confusing similarity to the earlier cited mark, in particular (i) the srvices in Class 35 covered by these marks are identical and/or similar to each other, and (ii) the stylized word "zenith", prominently presented, as the dominant, distinctive element of the applied-for mark is identical to the main component "ZENITH" of the cited mark "ZENITH MEDIA" already registered.
