“AYUVITA (Forte)” is accepted for registration

The applied-for mark “AYUVITA (Forte)” under application No. 4-2013-12472 of Welex Laboratories Pvt. Ltd. (India) has been temporarily refused for registration by the IP Vietnam on the ground of confusing similarity with the cited marks “YUVITA” and “ACUVITA”.
The applicant appealed and provided the evidence that the two above cited marks had been terminated by the IP Vietnam previously.
The IP Vietnam revoked its previous refusal, issued a decision to register the mark.
