“DON DON:DONKI” vs. “DONKI, Japanese characters, pictures”

On behalf of and authorized by the owner of the mark "DON DON:DONKI" under Application No. 4-2020-39330 filed on September 25, 2020, Pham & Associates objected to the IP Vietnam the filing of application No. 4-2021-02306 filed on January 19, 2021 to register the mark "DONKI DONKI, Japanese characters, pictures" for products of Class 35 on the grounds that the latter is confusingly similar to the former "DON DON:DONKI" with earlier filing date, specifically: (i) these marks are similar in structure, visual impression and overall impression, and (ii) the services for which these marks sought for registration are identical and similar to each other.
The case is being handled by the IP Vietnam
