Notice of extension of deadline for applicants affected by the Covid-19 epidemic

Previously, the IP Vietnam (NOIP) issued Notice No.7581/TB-SHTT of August 2, 2021, according to which the procedures related to the establishment of industrial property rights at the IP Vietnam that must be done within the period from June 30, 2021 to the end of August 31, 2021 is automatically extended until the end of September 30, 2021.

However, up to now, the Covid-19 epidemic has continued to seriously affect all aspects of socio-economic life. Therefore, on September 9, 2021, the IP Vietnam further issued Notice No. 8181/TB-SHTT on the application of legal provisions on time limit for applicants affected by the Covid-19 epidemic. Accordingly, all procedures related to the establishment of industrial property rights (such as requesting priority rights, supplementing documents, responding to office actions, maintaining and extending the validity of protection titles, payment of fees, charges, filing complaints, etc..) due in the period from June 30, 2021 to the end of October 31, 2021 is automatically extended until the end of November 30, 2021.

For other cases, if the applicant is affected by the Covid-19 epidemic on the exercise of his/her rights and obligations in the procedures for establishing industrial property rights at the IP Vietnam, he/she has the right to request the application of regulations on objective obstacles and force majeure events at Points 9.4, 9.5 of Circular No. 01/2007/TT-BKHCN, amended and supplemented according to Circular No. 16/2016/TT-BKHCN.
