Successfully opposed trademark application “BOSCH’S MAX Utility House - Smart Kitchen, figure”

National trademark application No.4-2020-42182  “BOSCH’S MAX Utility House - Smart Kitchen, figure”under the name of  DUKO Vietnam Import-Export and Trading Ltd., (the applicant),  filed on October 13, for products/services " Buying, selling, importing and exporting household appliances such as: lamps and lighting equipment, electric oil-free fryers, electric stoves, induction cookers, gas stoves, microwaves, ovens, baking machines, blender, juicer, electric kettle, iron, iron, personal electric fan, range hood, dryer, kitchen utensils such as pots, pans, pans, food containers, knife, scissors" in Class 35 was opposed by Robert Bosch GmbH on the grounds that the sign sought to be registered was confusingly similar to the cited earlier marks currently in effect in Vietnam, namely  National Trademark Registration No.173621 “BOSCH Sáng tạo vì cuộc sống, hình” (“BOSCH Innovative for life, figure" and International Trademark Registration No. 649624 "BOSCH" designating Vietnam.

The IP Vietnam, based on results of substantive examination, held that the opposing party's opinion was well-founded and informed relevant parties accordingly to respond. As the 3-month time limit to respond has expired but the applicant has not taken action, the IP Vietnam issued the decision to reject the applied-for mark  “BOSCH’S MAX Utility House - Smart Kitchen, figure”.
