The mark is Japanese characters – Appeal against the IP Vietnam’s refusal

The applied-for mark in Japanese characters (image attached) under international registration No. 1520282  of IKEDA MOHANDO CO., LTD. (JP) has been temporarily refused for registration by the IP Vietnam on the ground that the characters contained in the mark belonged to languages not commonly used in Vietnam (Article 74.2(a), IP Law).
On behalf of and authorized by the applicant, Pham & Associates appealed the IP Vietanm’s refusal decision, arguing that in this particular case the mark has been widely used and recognized by the Vietnamese consumers and in-Vietnam living foreigners knowing Japanese, therefore to apply Article 74.2(a) with regard to uncommon language in ignoring the actual commercial business of the mark on the market would be inappropriate.
The case is being reviewed by the IP Vietnam.
