“UT Since 2019, figure” is refused for registration

Applied-for mark “UT Since 2019, figure” under the name of TIMEX (VN) Co., Ltd. sought for registration of “Fashion clothing” products in Class 25  is being refused for registration  the grounds that it is likely to cause confusion with the prior marks of VN Reg.No.210467; No.139183 and Intl’ Reg.No.1236253 designating Vietnam.

Specifically, the IP Vietnam held  that the word UT – the dominating element  of the applied-for mark - is similar to the cited marks in terms of structure and pronunciation,  registered for the similar products and services, is likely to mislead consumers into thinking they belong to the same owner.

The case is being reviewed by the NOIP.
