"YES" vs. “YS MENTHOL CIGARETTES, figure ” and “YS, figure”

Pham & Asociates, authorized by the owner of Trademark Reg.No. 81942 “YES”, issued on May 9, 2007 for protection of the products “tobacco; cigarettes, smoker's items; matches” in Class 34, has filed an application with the IP Vietnam (NOIP0 to object applied-for trademark applications No.4-20210-53316 “YS MENTHOL CIGARETTES, figure ”, filed on December 18, 2020 and No. 4-2020-28112 “YS, figure”, filed on December 18, 2020. The reason for the objection is that the two above-mentioned applied-for marks are confusingly similar to the cited prior mark "YES" in terms of structure and pronunciation have the same products sought for registration as those of the cited mark.
The case is being handled by the NOIP.
