Client Results: Pham & Associates Advised Procter & Gamble International Operation, S.A to Appeal “INVITATION AU VOYAGE” Mark

Pham & Associates has advised Procter & Gamble International Operation, S.A to appeal successfully against the National Office of Intellectual Property (“NOIP”)’s decision of refusal on the following grounds.

There was a low degree of phonetic similarity between the marks as the elements of the mark applied for contained three words in comparison with the cited mark of “INVITATION”. Conceptually, there was different meaning between “INVITATION AU VOYAGE” and “INVITATION”.

On August 4, 2014, the NOIP issued Decision no. 2609/QD-SHTT to accept protection the “INVITATION AU VOYAGE” mark in Vietnam.
