Pham & Associates has successfully obtained the following decisions dated April 22, 2016 on revocation of the various trademarks on behalf of the clients.

Initiating a none-use cancellation action against the cited trademark registration is one of option to overcome the obstacle during the process of seeking trademark registration in Vietnam. In principle, to initiate a non-use cancellation action against a trademark registration, the appellant bears the burden of proof to show the non-use of the contested trademark. If the burden is met, the burden of showing the use of the contested trademark will then shift to the trademark owner.
