Client Update: New Regulation on Corporate Naming

From November 26, 2014, Circular no. 10/2014/TT-BVHTTDL that deals with corporate naming will have new regulations. Pham & Associates reports on the main changes. When searching the availability of a new company name, the proposed name must be distinguishable from any other corporation name on file but not in the following cases.

- To use name of celebrities for corporate naming. If a new company name is given by linking names of its founders which coincides with a name of great man, then it must have a hyphen between the linking names.

- To use former name of country, places which were used in the period of being invasion and the name of persons in history who were considered as a factor to hinder the progress; an invader or those who were guilty to the country, the nation;

- To use of words, symbols which violate historical traditions as prescribed by law.
