Client/Legal Alert: Decree No. 05/2015/ND-CP on detailed implementation of some of articles of the Labor Code

On January 12, 2015, the Government issued Decree No. 05/2015/ND-CP which provides guidance on implementation of some of articles of the Labor Code.

The guide provides specific issues of contract labor, wages, labor discipline, responsibility and settlement of labor disputes.

This Decree takes effect from March 1, 2015 to replace Decree 196/CP dated 31.12.1994; Decree No. 93/2002/ND-CP dated 11.11.2002; Decree No. 41/CP dated 07.06.1995; Decree No. 33/2003/ND-CP dated 02.4.2003; Decree No. 11/2008/ND-CP dated 30/01/2008. The previous regulations contrary to the provisions of this Decree shall be null and void from the effective date of this Decree.

Labor contracts, collective labor agreements, labor rules and regulations signed or issued prior to the effective date of this Decree shall be reviewed, amended, supplemented and implemented in accordance with the Decree by the involved parties.
