Client/Legal Alert: New Guidance on Revocation of Domain Names Infringing IP rights

Circular No. 14/2016/TTLT-BTTTT-BKHCN will take effect from July 25, 2016, providing guidance on possible revocation of domain names infringing IP rights.  

According to this Joint Circular, revocation of domain names will be applied in the following cases.

1. 1. The holder of domain name “.vn” infringes the intellectual property law and does not carry out the appropriate measures to remedy the consequences, namely, changing information on the infringing domain name “.vn” or returning the infringing domain name “.vn” to the Governing Office within 30 days from the date of decision on administrative punishment.
2. 2. The holder of domain name “.vn” does not carry out the removal of infringing information from its website using the domain name “.vn” in pursuant to an order of the competent authorities.
