Method of printing and distribution newspapers does not protected under the Copyright Act

Mrs. Hoang Thi Thanh Huong is the owner of copyright of "Method of printing and distribution newspapers” in the form of "writing work". Under the Copyright act, the scope of protection of his work is the way to express, the style of writing, the particular sentences in the work at issue.

Most recently, Mrs. Huong has lodged a complaint to the authorities that XTD Printing Co., Ltd infringed her copyright since the act of using “the method of printing and distribution newspapers” in its business instituted copyright infringement.

Pham & Associates on behalf of XTD expressed the view on the matter that XTD have not infringed on the copyright of Mrs. Huong because of the following reasons:

i) The method of printing and distribution newspapers has not been protected under the Copyright Act (Article 15 of the Intellectual Property Law).

ii ) XTD has not used or copied the above writing work as well as using the way to express, the style of writing, the particular sentences in the work.
