Pham & Associates Advises Comité International Olympique on Its Invalidation Action against the Mark OLYMPIC

Pham & Associates advised Comité International Olympique in connection with its invalidation action against the mark OLYMPIC in the name of PD Licensing Pty Limited (AU) under National Registration No. 11101 for the goods in Class 12 in Vietnam.  

The National Office of Intellectual Property upheld the appellant in finding that PD Licensing Pty Limited, the owner of the mark OLYMPIC under National Registration No. 11101 had not used the contested mark in continuous period of 5 years; and the respondent failed to respond to the Trademark Office’s notification.  

In principle, to initiate a non-use cancellation action against a trademark registration, the appellant bears the burden of proof to show the non-use of the contested trademark. If the burden is met, the burden of showing the use of the contested trademark will then shift to the trademark owner.
