Vietnam: Lawyers have to participate in professional training course at least 2 days/ a year
On April 7, 2014, the Ministry of Justice issued Circular No. 10/2014/TT-BTP guiding the obligation to participate in professional training course.
According to the provisions of the Circular, the time of training is at least 2 working days/ a year (16 working hours/ a year). Prior to December 15th every year, lawyers are obliged to submit to the Bar Association where the lawyers are members the documents as provided in Article 14 of the Circular to demonstrate their fulfilled obligation. Article 10.2 of the Circular also provides some cases being excused from participating in such professional training course (e.g. lecturers of professional training courses or law practice skills training classes etc).
The organizations are eligible to implement professional training courses include:
a) Vietnam Bar Federation
b) Local Bar Associates
c) Organizations training professional lawyers
d) Law practice organizations
Every year, on the basis of agreement with Vietnam Bar Federation, local Bar Association will decide a list of law practice organizations which is enough qualification and condition to hold professional training courses.
The Circular become effective as from May 21, 2014.
