Continuation of PPH Pilot Program between NOIP - JPO for patent applications until 2022

The National Office of Intellectual Property (NOIP)  and the Japanese Patent Office (JPO) will continue PPH pilot program (PPH Program) Phase 2 in 3 years from April 1, 2019 to 31/3/2022 after completing the pilot implementation of PPH Program Phase 1 (April 1, 2016 - March 31, 2019).

Applied-for mark COMMUNITY under application 4-2011-28083 dated December 29th 2011 for Class 25 and Class 35 in the name of  Aritzia LP (Canada) was denied  registration by NOIP for the reasons of being descriptive and/or liable to mislead, confuse or deceive consumers as to the origin, functional parameters, intended purposes...of the goods/services.

On February 18, 2019, the People's Court of District 1, Ho Chi Minh City returned a first-instance verdict to recognize painter Le Linh as the only author of the "Infant Progidies of Viet country" comics. This copyright ownership dispute has lasted for 12 years, attracted public interest, especially the publishing community.

Intl' application no.1168792 "AQUA KEEP" for goods of Class 01 in the name of Sumitomo Seika Chemicals Co., Ltd. was temporarily refused to registration on the ground that the "AQUA KEEP" sign does not meet the protection requirements as provided for in Article 74.2 c of IP Law, namely it's descriptive.

A cancellation request is filed to NOIP agaisnt  trademark Registration no.147365 "Fantiny, figure" for goods of Class 11 "Sanitary apparatus (baths, showers, wash basins) made of mica and composite materials" on the ground  that it fails to meet the registrability criteria...

Review of NOIP's settlement of appeal requests in 2017

The Annual Report 2017 of NOIP, published in October 2018, showed that in this year 1.318 appeal requests against its decisions on refusal on granting IP protection titles were received,  of which only 730 ( 55% of the total) were considered valid and accepted for settlement by the NOIP...
